U.S. Privacy Policy

Ethique Consumer Products Inc. (“Ethique,” “we,” “us,” or “our”) respects your privacy. This U.S. Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit ethique.com from the United States, create an account, make a purchase, join Ethique Rewards, subscribe to email or text messages, contact us, or otherwise interact with our U.S. services (collectively, the “Services”).
This Privacy Policy is a notice of our practices. It is not a request for blanket consent. Where consent is required, we request it separately and allow you to withdraw it as provided by applicable law.
1. Personal Information We Collect
Depending on how you interact with us, we may collect the following categories of personal information:
- Identifiers and contact information. Name, email address, telephone number, billing and shipping addresses, account identifier, IP address, and similar identifiers.
- Account and authentication information. Account login details and information used to authenticate or secure your account. Passwords are managed through our commerce platform and are not stored by Ethique in readable form.
- Commercial information. Products purchased, considered, or returned; order and transaction history; product preferences; subscriptions; promotions used; and Ethique Rewards membership, points, and redemption activity.
- Payment information. Our payment processor collects payment-card and related transaction information. Ethique does not receive or store full payment-card numbers.
- Internet and device activity. Browser and device type, operating system, IP address, cookie and advertising identifiers, pages viewed, links clicked, referring pages, search activity on the Services, interactions with advertisements, and dates and times of visits.
- Location information. Billing and shipping addresses and approximate location that may be inferred from an IP address. We do not collect device GPS data or similarly precise geolocation through the Services.
- Communications and customer-service information. The content of emails, text messages, customer-service requests, reviews, survey responses, social-media communications, and other messages you send to us.
- Product experience and health information. Information you choose to provide about product use, allergies, reactions, injuries, or adverse events. Please provide only information needed for us to address your report.
- Demographic and preference information. Birthday, product preferences, and information you choose to provide through surveys, reviews, promotions, or account settings.
- Inferences. Preferences or likely interests derived from purchase, browsing, and interaction information, such as products or offers that may interest you.
Information We Do Not Collect
We do not collect biometric information through the Services and do not use personal information to make automated decisions that produce legal or similarly significant effects concerning consumers.
Sources of Personal Information
We collect personal information:
- directly from you, including when you place an order, create an account, join Ethique Rewards, subscribe to marketing, contact customer service, or submit a product report;
- automatically from your browser or device through cookies, pixels, tags, software development kits, and similar technologies; and
- from service providers acting on our behalf, such as our commerce, payment, customer-service, rewards, analytics, and advertising providers.
2. How We Use Personal Information
We may use personal information to:
- provide, operate, maintain, and improve the Services;
- process payments, orders, subscriptions, shipping, returns, refunds, and warranties;
- create and administer accounts and Ethique Rewards membership;
- respond to questions, requests, complaints, reviews, and customer-service communications;
- send transactional messages and, with appropriate permission, marketing emails and text messages;
- personalize content, recommend products, measure campaign performance, and deliver advertising;
- analyze use of the Services and develop products, features, and customer experiences;
- detect, investigate, and prevent fraud, security incidents, abuse, and violations of our terms;
- evaluate product quality and safety, investigate adverse events, and make reports to the U.S. Food and Drug Administration or other authorities when required; and
- comply with law, maintain business records, establish or defend legal claims, and protect the rights, safety, and property of Ethique, our customers, and others.
3. How We Disclose Personal Information
We may disclose personal information to the following categories of recipients for the purposes described in this Policy:
- Commerce and technology providers. Shopify and providers of hosting, databases, account tools, consent management, security, fraud prevention, backup, and related infrastructure.
- Payment processors. Providers that process payment credentials, authorizations, refunds, and transaction-related fraud checks.
- Fulfillment and delivery providers. Warehouses, logistics providers, and carriers that prepare and deliver orders.
- Customer engagement providers. Klaviyo for email and SMS communications, Okendo for rewards and customer engagement, Gorgias for customer support, and Consentmo for cookie and consent management.
- Analytics and advertising service providers. Google, Meta, TikTok, Pinterest, and other providers that process limited information on Ethique’s behalf to measure use, attribute conversions, and deliver or measure Ethique’s own advertising.
- Professional advisers. Lawyers, auditors, insurers, accountants, consultants, and other advisers subject to appropriate obligations.
- Government and legal recipients. Regulators, law enforcement, courts, and other parties when disclosure is required by law or reasonably necessary to protect rights, safety, and property.
- Corporate transaction recipients. Potential or actual buyers, investors, lenders, or advisers in connection with a merger, financing, acquisition, reorganization, bankruptcy, or sale of assets.
We may also disclose personal information at your direction or with your consent. We may use and disclose information that has been aggregated or deidentified so that it cannot reasonably be linked to you, and we maintain such information in deidentified form unless otherwise permitted by law.
4. Advertising and Our No-Sale/No-Share Commitment
We do not sell, rent, or share personal information with third parties for their own advertising purposes. We use advertising and analytics service providers, including Google, Meta, TikTok, and Pinterest, to deliver and measure Ethique’s own advertising. If you consent to advertising cookies through our cookie banner, these providers may process limited identifiers, commercial information, internet or electronic activity, and approximate location solely to provide advertising and measurement services to Ethique. We do not permit them to use this information for their own independent advertising purposes. Mobile opt-in information and SMS consent records are handled as described in Section 6.
You may reject advertising cookies using the choices presented through our cookie banner. You may also request that we stop advertising-cookie processing associated with you by emailing hello@ethique.com with the subject line “Privacy Opt-Out Request.” Your request will apply subject to applicable law and our ability to identify the browser, device, or account associated with the information.
We do not knowingly sell or share personal information of consumers under 16 years of age.
5. Cookies and Similar Technologies
We and our providers use cookies, pixels, tags, and similar technologies. These technologies may fall into the following categories:
- Strictly necessary. Required for checkout, account login, fraud prevention, security, load balancing, and core site functions.
- Functional. Remember choices, provide enhanced features, and support customer interactions.
- Analytics. Help us understand site traffic, performance, and how visitors use the Services.
- Advertising. With your consent, support the delivery, attribution, and measurement of Ethique’s own advertising.
You can accept or reject optional cookies using the choices presented through our cookie banner. You may also change your browser settings, but doing so may affect site functionality. Browser “Do Not Track” signals are not uniform, and we do not currently respond to them.
6. Email and Text Message Marketing
If you subscribe to marketing emails, you can unsubscribe using the link in any marketing email. If you consent to recurring marketing text messages, message frequency may vary and message and data rates may apply. Consent to marketing texts is not a condition of purchase. You can opt out at any time by replying STOP to a marketing text or by texting STOP to +1 (844) 668-4528. We may send one confirmation message after you opt out. We do not sell, rent, or share mobile opt-in information or SMS consent records with third parties for their own advertising or marketing purposes. We may disclose this information to service providers that help us operate our messaging program, but only to provide services on our behalf and subject to contractual restrictions.
7. Ethique Rewards and Promotional Incentives
Ethique may offer Ethique Rewards, first-purchase discounts, free shipping, points, or other promotions that may be considered financial incentives under applicable privacy law. The specific benefit and material program terms are presented when you enroll or participate and, for Ethique Rewards, in the applicable program terms.
Participation is voluntary. Depending on the offer, we may collect your name, email address, mobile number, birthday, account information, purchase history, preferences, and rewards activity. We use this information to administer the program, provide benefits, personalize offers, prevent fraud, and evaluate program performance.
You may join by following the enrollment instructions for the applicable program or offer. You may withdraw from email or SMS promotions using the methods in Section 6. To leave Ethique Rewards, contact hello@ethique.com. Withdrawal does not affect benefits already redeemed, but unused points or benefits may be forfeited as described in the program terms.
Our good-faith estimate of the value of participating consumers’ personal information is reasonably related to the value of the benefits provided. We estimate this value using the value of discounts, points, shipping benefits, and other rewards made available or redeemed; program and administration costs; the amount and nature of information collected; and anticipated revenue associated with participating customers. The value varies by participant because participation and benefit redemption vary.
8. Retention of Personal Information
We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, meet legal and accounting obligations, maintain security, resolve disputes, and enforce agreements. Unless a longer or shorter period is required by law or reasonably necessary in a particular case, we use the following retention periods:

When retention expires, we delete, aggregate, or deidentify information where reasonably practicable. Information may remain for a limited period in secure backups or be retained longer when subject to a legal hold or necessary for security, fraud prevention, disputes, or regulatory obligations.
9. U.S. State Privacy Rights
Depending on your state of residence and whether the applicable law applies to Ethique, you may have the right to:
- confirm whether we process your personal information and access or obtain a copy of it;
- correct inaccuracies;
- delete personal information, subject to legal exceptions;
- obtain portable copies of certain information;
- opt out of the sale or sharing of personal information and targeted advertising;
- opt out of qualifying profiling in furtherance of decisions that produce legal or similarly significant effects;
- limit or withdraw consent to certain uses of sensitive personal information, where applicable;
- appeal our denial of a privacy request; and
- receive equal service and pricing without unlawful discrimination for exercising privacy rights.
How to Exercise Your Rights
To submit an access, correction, deletion, portability, opt-out, or appeal request, email hello@ethique.com with the subject line “Privacy Request.” To reject optional advertising cookies when the cookie banner is displayed, use the choices provided through that banner.
Please describe your request and provide information reasonably necessary to identify relevant records, such as your name and the email address associated with your account or orders. We use verification information only to process the request. We will not require you to create an account solely to exercise a privacy right.
Authorized Agents
Where permitted, an authorized agent may submit a request for you. We may require proof of the agent’s authority and may ask you to verify your identity or confirm the request directly, unless the agent has a valid power of attorney under applicable law.
Responses and Appeals
We respond within the period required by applicable law and may extend the response period when permitted. If we deny your request, we will explain the basis for the denial and, where applicable, how to appeal. To appeal, email hello@ethique.com with the subject line “Privacy Appeal” within 60 days of our decision. If an appeal is denied, you may contact your state attorney general or other applicable regulator.
California Disclosures
During the preceding 12 months, we collected the categories of personal information described in Section 1 from the sources described there. We used and disclosed those categories for the business and commercial purposes described in Sections 2 and 3.
During the preceding 12 months, we did not sell or share personal information, as those terms are defined by California law. We do not knowingly sell or share personal information of consumers under 16.
We use or disclose sensitive personal information only for purposes reasonably necessary to provide requested goods or services, process payments through our providers, maintain account security, respond to product-safety reports, comply with law, and other purposes permitted without a right to limit under applicable California law. We do not use sensitive personal information to infer characteristics about consumers.
10. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. These measures include access controls, service-provider diligence, secure transmission where appropriate, monitoring, and procedures for responding to security incidents. No system or transmission is completely secure, and we cannot guarantee absolute security.
11. Children’s Privacy
The Services are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information online from children under 13. If you believe a child under 13 has provided personal information to us, contact hello@ethique.com so we can investigate and delete it as appropriate. We do not knowingly sell or share personal information of consumers under 16.
12. Third-Party Services
The Services may link to websites, applications, social-media platforms, or services operated by third parties. Their privacy practices are governed by their own notices. We encourage you to review those notices before providing information to them.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will post the revised version and update the “Last Updated and Effective” date. If required by law, we will provide additional notice or obtain consent before applying material changes to personal information already collected.
